1. Scope of application

a) The guidelines apply to all registered users for all pages and services provided on gearkinks.de.

b) The guidelines are always accessible on the internet and can be printed out. They apply to all free and paid one-time or ongoing services.

c) Contrary or deviating conditions of the user do not apply.

d) GEARKINKS reserves the right to change these guidelines at any time. GEARKINKS is not obliged to notify every user of the website of changes to the guidelines. Changes to the guidelines will be implemented and must be confirmed again after login. Rejection results in the deletion of the user profile.

e) In case of doubt about the rules listed here, the final decision lies with the administrators/moderators. They are to be respected and followed.

2. Usage

According to these guidelines, GEARKINKS grants the user a non-exclusive, non-transferable, and limited right to access and use gearkinks.de. This is solely for personal and non-commercial purposes.

3. Netiquette

The following points regulate the interaction with other users on gearkinks.de, especially regarding the creation of graphics and/or tests.
  • The general tone should be polite and courteous towards other users
  • Users commit to respecting applicable law and good manners. In particular, it is undesirable to:
    • Publish offensive, racist, discriminatory, inciting violence, or untrue content.
    • Post sexual content in areas accessible without age restriction.
    • Post content in any form that clearly targets individuals under 18 years of age.
    • Post private information of third parties without their consent.
    • Publish content of third parties without attribution and their explicit consent.
    • Use so-called referral links, affiliate links, or advertising links.
    • Post contact information in publicly accessible areas.
In case of violation of the aforementioned rules, the administrator/moderator may take the following measures:
  • Deletion, modification, or merging of content posted by the user,
  • Issuance of a warning or
  • Blocking access to the entire site (temporary or permanent bans).

4. User account

The following provisions govern the use of your profile on gearkinks.de

a) Creating a user account
  • Anyone who has reached the minimum age of 18 can create a user account on GEARKINKS free of charge and use all functions of the site. However, double accounts, fake accounts, or other violations of netiquette are excluded and will be penalized with the above-mentioned measures.
  • The created user account is personal and may only be used by oneself. Using a user account by multiple users is not permitted. It is allowed to present the profile as a community.
b) Deleting the user account
  • It is possible to delete your profile on gearkinks.de at any time and without giving reasons. The option to delete is located under "My Account".
  • The user account will be marked for deletion for 1 week. During this time, it is possible to cancel the deletion process on the above-mentioned page. After the deletion period expires, the user account, including all content except the exceptions mentioned under c), will be deleted.
c) Content not removed upon deletion of the user account
  • Through the use of gearkinks.de, there are many interconnections with functions of the website that are important for other users. In order to provide a smooth service, some user-created content will not be removed. Of the listed content, everything except the mentioned data will be removed.
    • All graphics will remain
    • All BDSM tests will remain
    • All GEARKINKS graphics will remain
  • Attention: The link for editing graphics and tests will be removed. After the permanent deletion of the account, this function will no longer be available to the user.

5. User-generated content

The following provisions govern the creation, use, and distribution of user-generated content.

a) Images
Wherever images can be uploaded on gearkinks.de, the following guidelines must be observed
  • Images with offensive, racist, discriminatory, inciting violence, or untrue content are prohibited!
  • You are the author of the image or have the written consent of the author for publication (Please indicate in the description or title of the image)
  • Images that clearly target individuals under 18 years of age are prohibited.
All images in the Album and FakeCheck sections are checked for content and either released for all users to see, deleted, or marked as FSK18 (meaning only users who have proven their age can see the images).

In all other areas (e.g., profile including profile and background images), only family-friendly images are permitted. FSK18 images will be deleted.

b) Event graphics
  • To better represent events, the event administrators of the respective events have the option to upload their event logo.
  • The image rights of the uploaded images go to gearkinks.de. The images can be published by the provider for advertising purposes in any media. Subsequent claims by the user are excluded.
c) Texts
  • In your profile, you have the option to provide a description. Texts with offensive, racist, discriminatory, inciting violence, or untrue content are prohibited!.
  • Always consider that there are real people behind the screen when evaluating.

6. Limitation of liability

a) Own content
All content on our website has been created with care and to the best of our knowledge. However, no guarantee can be given for the topicality, completeness, and correctness of all pages. This also includes the page "Events".

According to § 7 para. 1 TMG, we as a service provider are responsible for our own content on these pages in accordance with general laws, but according to §§ 8 to 10 TMG, we are not obliged to monitor transmitted or stored third-party information. Immediate removal of these contents will be made from the time of knowledge of a specific legal violation, and we are not liable before the time of knowledge acquisition.

b) External links
Our website contains so-called "external links" (links to third-party websites), over whose content we have no influence and for which we therefore do not assume any liability. The respective provider or operator of the linked websites is responsible for the content and accuracy of the information provided. When the link was made, no legal violations were discernible to us. If we become aware of any legal infringements, the respective link will be removed immediately by us.

Any kind of duplication, processing, distribution, and any kind of exploitation beyond the limits of copyright law requires the prior written consent of the respective author or creator. In the graphics and BDSM tests, these are visible on the image. Creator names may also be included there.

8. GearPro (Coming Soon)

With GearPro, you support the development of GEARKINKS and receive various benefits as a thank you. The benefits can be changed, expanded, or removed at any time. Current information on the benefits can be viewed here.

Refund
In case of temporary bans of the user account, GearPro can optionally be extended for the duration of the ban or refunded proportionally for the duration of the ban. In case of permanent bans of the user account, GearPro may be refunded proportionally. This is at the discretion of the team. Upon termination of the site, GearPro will be refunded proportionally.
